Products
The website sells photographic prints by Gavin Bernard, including limited-edition prints supplied framed or unframed.
Product descriptions, dimensions, framing options and edition sizes are shown on the relevant product page. Please check these details carefully before ordering.
Computer screens display colours differently, so the appearance of a physical print may vary slightly from its on-screen representation. Minor variations do not constitute a fault.
Limited editions
Where a product is described as a limited edition, the edition size stated applies to that particular print size. Each limited-edition print is signed and numbered.
Availability is subject to the remaining quantity in the relevant edition. Purchasing a print does not transfer copyright or reproduction rights.
Prices and payment
Prices are displayed in pounds sterling unless otherwise stated. The complete price, including any applicable delivery charges and taxes, will be shown before payment is confirmed.
Payments are processed securely by Squarespace Payments and its payment partners. Gavin Bernard Photography does not receive or store complete payment-card details.
Payment is taken when the order is placed.
Order acceptance
After ordering, you will receive an electronic confirmation. An order may be declined or cancelled before production if:
Payment cannot be authorised.
The product is unavailable.
There is an obvious pricing or description error.
Delivery cannot reasonably be made to the supplied address.
Fraud or unauthorised activity is suspected.
If an order is cancelled after payment, the amount paid will be refunded.
Production and fulfilment
Prints and frames are produced and fulfilled through Creativehub and its associated professional print-production services.
Production begins after an order is accepted. Dispatch and delivery estimates are not guaranteed dates, although reasonable efforts will be made to meet them.
Delivery
Customers are responsible for providing a complete and accurate delivery address.
Unless a different period is agreed, goods will be delivered without undue delay and normally within 30 days of the order.
Delivery times may be affected by production requirements, destination, customs, courier delays or circumstances outside reasonable control.
For international orders, customers may be responsible for import duties, customs charges or local taxes imposed by the destination country.
Risk of loss or damage passes to the customer when the goods are delivered to the customer or a person identified by them.
Your right to cancel
UK consumers purchasing online normally have the right to cancel an order without giving a reason.
You must notify Gavin Bernard Photography within 14 days after the day the goods are delivered. After notifying me, you then have a further 14 days to return the goods.
To cancel, email gavbernard@gmail.com and include your name, order number and the product concerned.
Do not return a product before receiving return instructions. The return address may differ from the business correspondence address above.
You are responsible for the direct cost of returning unwanted goods unless they are faulty, damaged or incorrect. Suitable protective packaging and a tracked delivery service are recommended.
You may handle the goods only as necessary to establish their nature, characteristics and quality. A deduction may be made if unnecessary handling has reduced their value.
Refunds following cancellation
Where the statutory cancellation right applies, the product price and the cost of the least expensive standard delivery option offered will be refunded.
Additional delivery costs resulting from selecting an enhanced or express service are not refundable.
The refund will be made within 14 days after the returned goods are received, or after you provide evidence that they have been sent back, whichever occurs first.
Refunds will normally be made using the original payment method.
Personalised or bespoke products
The statutory cancellation right may not apply to goods made to a customer’s individual specifications or clearly personalised.
This exception will only be relied upon where a product genuinely meets those conditions and this has been made clear before purchase. Selecting a standard size or standard frame option does not necessarily make a product personalised.
Faulty, damaged or incorrect goods
Nothing in these terms affects your statutory rights.
If a product arrives faulty, damaged or incorrect, contact gavbernard@gmail.com as soon as reasonably possible. Include the order number, a description of the problem and clear photographs of the product and packaging where possible.
Depending on the circumstances, an appropriate remedy may include repair, replacement, price reduction or refund. Reasonable return costs for faulty, damaged or incorrect goods will not be charged to the customer.
Damage must not be reported falsely as transit damage where it occurred after delivery.
Failed or refused delivery
If delivery fails because the address supplied was incomplete or incorrect, or because delivery was unreasonably refused or not collected, the customer may be responsible for reasonable redelivery or return costs.
Copyright
All photographs and website content remain protected by copyright.
Buying a print gives ownership of that physical copy only. It does not grant permission to copy, scan, reproduce, publish, commercially exploit or create derivative works from the photograph.
Liability
Gavin Bernard Photography is responsible for losses that are a foreseeable consequence of breaching these terms.
Nothing in these terms excludes liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights.
Products are sold primarily for personal use. Gavin Bernard Photography is not responsible for indirect business losses arising from consumer purchases.
Privacy
Personal information is handled in accordance with the website’s Privacy Policy.
Governing law
These terms are governed by the laws of England and Wales.
Consumers living elsewhere retain any mandatory protections provided by the law of their country of residence. Any dispute may be brought before the courts legally entitled to hear it.
